Mengo Magistrates Court has ordered Makerere University to pay lawyer Hassan Male Mabirizi a total of Shs 3million, as damages for failure to provide him with information he had requested from the university.
The court ruled that the University’s failure to furnish Mabirizi with Hon Robert Kyagulanyi’s certified copies of Application, Bio-data forms and Academic Transcript was illegal and in violation of the Access to Information Act of 2005.
Mabirizi had applied for this information on 21st August 2020 and expected it by 11 December 2020.
In her ruling, Mengo Chief Magistrate Esther Nasambu noted that she couldn’t overlook some of the illegalities on the side of the university.
She noted that the university as public body is expected to uphold efficiently, transparency, effectiveness and accountability.”
Although Mabirizi had asked for 5 million shillings as General aggravated and exemplary damages, court awarded him 3 million Shillings with taxed costs for the application.
