Masaka High Court Judge Victoria Nakintu Katamba has scheduled 20th September 2021 for the hearing of the bail application filed by National Unity Platform (NUP) Members of Parliament; Hon Muhammad Ssegirinya (Kawempe North) and Hon Allan Sewanyana (Makindye West).
The two were arrested and remanded by Masaka Chief Magistrate Charles Yeteise over three counts of murder and one count of attempted murder said to have occurred in the Greater Masaka region.
Since the charges against them are capital in nature (only heard by High Court), they didn’t take plea but were remanded to Kitalya Prison until September 15, 2021 when they will return to Court for mentioning of the case.
On Monday September 13, the accused, through their lawyer Abubaker Ssekanjako of Lukwago and Company Advocates, filed their bail Application to High Court seeking to be released pending hearing of their case.
Among the grounds brought before the attention of court is that bail is their Constitutional right with presumption of innocence and that they have got substantial sureties.
“Those who were in court heard it that by the time of arrest, the prosecution was still conducting investigations in the matter,” Ssekanjako, their lawyer, said.
He also pointed out that the two legislators are suffering from complications which require them to have special medical attention which they can’t access detention.
“The other most important issue is that they are Members of Parliament with a duty of representing their electorates who have a right to be fully represented in Parliament.”
